KRS 286.9-071 provides, in its entirety, that "the commissioner shall not issue additional deferred deposit service business licenses," and the 2019 amendment (2019 Ky. Acts ch. 34, sec. 2) struck the original ten-year sunset, making that bar permanent. It bars licensing, not lending: businesses already holding a licence continue to transact, and KRS 286.9-100 - amended effective July 15, 2024 - sets the price and the structure. A licensee "shall not charge a service fee in excess of fifteen dollars ($15) per one hundred dollars ($100) on the face amount of a deferred deposit check," prorated, and that fee covers a period of at least fourteen (14) days. A customer may hold no more than two transactions at one time and may not receive more than five hundred dollars ($500) in total proceeds across them (§ 286.9-100(9)). A licensee may not agree to hold a transaction for more than sixty (60) days (§ 286.9-100(12)), and may not "for a fee renew, roll over, or otherwise consolidate" one (§ 286.9-100(14)).
