Missouri regulates small unsecured lending under Mo. Rev. Stat. § 408.500, which applies to lenders “in the business of making unsecured loans of five hundred dollars or less”. Missouri sets no statutory rate cap: § 408.500(2) requires that these lenders “contract for and receive simple interest and fees in accordance with sections” 408.100 and 408.140, and § 408.100 allows interest on the unpaid principal balance “at rates agreed to by the parties”. The rate is therefore fixed by the loan agreement rather than by statute. The lender must renew the loan on the borrower's written request and payment of the interest and fees then due, but upon the first renewal and each renewal after it the borrower must reduce the principal by not less than 5% of the original loan amount. A borrower may cancel without cost by returning the full principal balance by the close of the lender's next full business day, and Regulation Z disclosures must be provided on every loan, renewal or extension.
